3 THE APPLICATION

Application is hereby made on behalf of the Developer (Please refer Annexure A) for the following:

* The Rezoning of Erven 1331, 2944 and 3556 Knysna from “Industrial Zone” to “Business Zone” for the purpose of shops, offices and apartments in terms of Section 17 of the Land Use Planning Ordinance (Ordinance 15 of 1985).

* Departure from the Knysna Zoning Scheme in terms of Section 15 of the Land Use Planning Ordinance (Ordinance 15 of 1985) to allow a height relaxation from 12m to 14m on Erven 1331, 2944 and 3556 Knysna, to allow buildings with maximum four storey’s.

* Alienation of a portion of Municipal Road (New Street) in terms of Section 137 of the Municipal Ordinance (Ordinance 20 of 1974), being a portion of Erf 1316 Knysna, approximately 1837 m˛, to the east and south of Erven 1331 and 2944 Knysna. The closure thereof as a Municipal Road to provide a pedestrian priority zone. The rezoning of this portion to “Business” in terms of Section 17 of the Land Use Planning Ordinance (Ordinance 15 of 1985).

* Alienation/Lease of a portion of unmade Municipal Road (Tide Street) in terms of Section 137 of the Municipal Ordinance (Ordinance 20 of 1974), being a portion of Erf 1316 Knysna, approximately 804 m˛, to the east of Erf 3402 Knysna. The closure thereof as a Municipal Road to allow a public parking area.

* The Redevelopment of a portion of Erf 1339 Knysna (Municipal Land) into a Public Park and communal facilities, including the upgrade / relocation of the existing facilities eg. Sea Cadets and Driving Test Center Facility.
